Welcome to Daily Gaming. These Terms of Service ("Terms") govern your use of the Daily Gaming platform, mobile application, website, and related services operated by Daily Gaming LLC ("Daily Gaming", "we", "our", or "us"). By accessing or using the Daily Gaming platform you agree to these Terms. If you do not agree with these Terms you may not use the platform.
Daily Gaming is a competitive skill-based video game platform that allows users to participate in head-to-head matches and tournaments using popular sports video games including Madden and NBA 2K.
Match outcomes are determined solely by the actual gameplay results and the skill of the players participating. Daily Gaming does not offer gambling, betting, casino games, fantasy sports wagering, or games of chance. Entry fees constitute contest participation fees, not wagers.
If you reside in, or are physically located in, any of the states listed above you are prohibited from participating in any real-money contests on the platform. Creating an account or participating in contests from a restricted state is a violation of these Terms and may result in immediate account termination and forfeiture of any winnings.
This list may change as laws are updated. It is your responsibility to verify that participation is legal in your jurisdiction before depositing funds or entering contests. Daily Gaming reserves the right to block access and void contests for users found to be in restricted jurisdictions.

Daily Gaming reserves the right to verify the identity and age of users at any time and may suspend or terminate accounts that fail verification. By using the platform you represent and warrant that you meet all eligibility requirements.

Daily Gaming operates as a skill-based competitive gaming platform. Winners of contests are determined exclusively by the gameplay results of the participants. No element of randomness, chance, or betting determines match outcomes. The platform is designed and operated in accordance with applicable skill gaming laws.
Daily Gaming charges a 10% platform service fee on the gross prize pool of each contest. This fee is deducted automatically before winnings are credited to the winner's wallet.
Example: In a $5 head-to-head contest, the gross prize pool is $10.00. Daily Gaming deducts a $1.00 service fee (10%). The winner receives $9.00.
In tournament contests, the service fee is deducted from the total entry fee pool. Winners receive the net prize pool after the platform fee is deducted.
By entering any paid contest you acknowledge and agree to the applicable platform fee structure.
Daily Gaming provides users with a platform wallet for depositing funds, participating in contests, and withdrawing available balances. Users acknowledge that:
Daily Gaming uses third-party payment processors to facilitate deposits and withdrawals. Daily Gaming does not store full payment card information.
Entry fees paid to join a contest are non-refundable once a contest has started. If a contest is cancelled by Daily Gaming before it begins, entry fees will be refunded to the user's platform wallet. If a technical error or platform failure prevents a contest from completing, Daily Gaming will determine the appropriate remedy at its sole discretion, which may include a full refund of entry fees.
Users are solely responsible for reporting and paying all applicable taxes on contest winnings. Daily Gaming does not provide tax advice.
In the United States, winnings may be subject to federal and state income tax. Daily Gaming may be required by law to report winnings to the Internal Revenue Service (IRS). Users who receive cumulative winnings of $600 or more in a calendar year may receive IRS Form 1099-MISC or 1099-NEC and may be required to provide their Social Security Number or Tax Identification Number for reporting purposes.
Failure to provide required tax information may result in mandatory federal backup withholding on winnings and/or suspension of withdrawal privileges.
Initiating a chargeback or fraudulent payment dispute with your bank or card issuer in connection with a deposit made on this platform is strictly prohibited.

Accounts engaging in prohibited activities may be permanently suspended and applicable funds forfeited.
Users are required to submit proof of match results (such as a photograph of the final score screen) within the time period specified for each contest. Failure to submit proof may result in a loss being recorded for that contest.

Submitting falsified, altered, or fraudulent proof of results is a violation of these Terms and may result in permanent account termination and forfeiture of all funds.
Daily Gaming may use automated systems and manual review processes to verify match outcomes and resolve disputes between players. Decisions made by Daily Gaming regarding disputes are final and binding.

Daily Gaming reserves the right to impose account-level spending limits, require cooling-off periods, or suspend accounts at its sole discretion for responsible gaming purposes.
We do not guarantee uninterrupted access to the platform. Features and services may be updated, modified, or temporarily unavailable from time to time. Daily Gaming is not liable for losses resulting from service interruptions or downtime.
All platform content including logos, branding, software, and platform design are owned by Daily Gaming LLC and protected by applicable intellectual property laws. Users may not copy, distribute, or reproduce platform content without written permission.
Users grant Daily Gaming a non-exclusive, royalty-free license to use content submitted to the platform (such as result photos) solely for the purpose of operating and improving the platform.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DAILY GAMING EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
DAILY GAMING DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAILY GAMING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE PLATFORM, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF DAILY GAMING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL DAILY GAMING'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU DEPOSITED ON THE PLATFORM IN THE 90 DAYS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Use of the platform is at the user's own risk.
You agree to indemnify, defend, and hold harmless Daily Gaming LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any contest result dispute involving your account.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
The arbitration shall take place in Atlanta, Georgia, or via remote proceedings if mutually agreed. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND DAILY GAMING AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a class or representative proceeding.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Daily Gaming reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity. Upon termination for fraud, abuse, or chargeback activity, Daily Gaming may:
Daily Gaming may update these Terms periodically. We will notify users of material changes through the app or by email. Continued use of the platform after updates constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Subject to the arbitration agreement in Section 19, any legal action shall be brought in the state or federal courts located in Fulton County, Georgia.
Daily Gaming provides tools that allow users to block and report other users on the platform.
Users may block another user at any time. When a user is blocked:
Users may report other users for suspected violations of these Terms, including cheating, abusive behavior, harassment, or collusion. Reports are reviewed by Daily Gaming and may result in investigation, account suspension, or permanent ban. Daily Gaming does not guarantee any specific action in response to a report and does not disclose the outcome of investigations to the reporting party.
Daily Gaming reserves the right to remove any user from a contest, restrict account features, or permanently ban any account that is found to have violated these Terms, regardless of whether a formal report was submitted.
Users may request deletion of their account at any time by contacting Daily Gaming support at support@daily-gaming.com with the subject line "Account Deletion Request".
Before account deletion is processed:
Daily Gaming may retain certain account information after deletion as required by applicable law, for fraud prevention, tax reporting obligations, or to enforce these Terms against users previously banned for abuse. Retained data will be stored securely and not used for any other purpose.
Deposits and withdrawals on the Daily Gaming platform are processed exclusively through third-party payment processors. Daily Gaming does not process payments through Apple In-App Purchase, Google Play Billing, or similar platform-native payment systems. By depositing funds on the platform, you acknowledge that transactions occur outside of the Apple App Store and Google Play Store payment frameworks and are governed solely by these Terms and the terms of the applicable third-party payment processor.
Daily Gaming shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, power outages, internet service disruptions, government actions, pandemics, or third-party service failures. In such events, Daily Gaming will make reasonable efforts to restore service and notify affected users as soon as practicable.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Daily Gaming with respect to your use of the platform and supersede all prior agreements.
