Daily Gaming LLC ("Daily Gaming", "we", "our", or "us") respects the privacy of our users and is committed to protecting personal information. This Privacy Policy describes how information is collected, used, disclosed, and protected when users access the Daily Gaming platform, mobile application, website, or related services (collectively, the "Platform").

By using the Platform you agree to the practices described in this Privacy Policy. If you do not agree, do not use the Platform.

1. Information We Collect

We may collect several types of information when users interact with the Platform.

Account Information

Identity and Tax Verification Information

To comply with U.S. tax reporting obligations, Daily Gaming may initiate a W-9 collection process for users who reach the applicable IRS reporting threshold ($600 in winnings per calendar year). This process is handled by our third-party tax reporting partner, Tax1099, which collects the following information directly from the user:

Daily Gaming does not store your SSN, ITIN, or government-issued tax identification number on its own servers. This information is transmitted directly to Tax1099 and used solely to fulfill IRS 1099 reporting requirements as required by law.

Device and Technical Information

Geolocation Information

Daily Gaming collects your IP address to determine your approximate geographic location (state or region). This information is used to enforce geographic restrictions and block access from jurisdictions where real-money skill gaming contests are not permitted by law. The restricted states are listed in Section 2 of our Terms of Service. Daily Gaming does not collect precise GPS-level location data.

This list may change as laws are updated. When a user's IP address indicates they are located in a restricted jurisdiction, access to real-money contest features will be blocked. This check may be cached locally on the device for up to 24 hours.

Gameplay and Platform Activity

Camera and Photo Data

When submitting contest results, users are required to capture a photo of the final game score screen as proof of the match outcome. These images are uploaded and stored for dispute resolution and match verification purposes. No other camera access is requested or used. Photos submitted for result verification may be reviewed by Daily Gaming staff.

Push Notification Data

With user permission, Daily Gaming collects push notification tokens to send contest-related alerts such as match invitations, match status updates, and contest results. Notification preferences can be managed from within the app or through your device settings. Revoking notification permission does not affect your ability to use the Platform.

Payment Information

Daily Gaming uses third-party payment processors to facilitate deposits and withdrawals. Payment information such as credit card or bank account details is handled directly by the payment processor and is not stored on Daily Gaming servers. Daily Gaming may receive transaction confirmation data (amounts, timestamps, transaction IDs) from payment processors to maintain wallet records.

Fraud Prevention and Ban Enforcement Data

When an account is suspended or permanently banned, Daily Gaming retains the associated IP address, device identifier, and account information to prevent the creation of new accounts in violation of the ban. This data is retained for as long as necessary to enforce the ban and protect the Platform.

Daily Gaming may also disclose information when required by law, court order, or government authority, or when necessary to protect the rights, property, or safety of Daily Gaming, its users, or the public.

4. Tax Reporting Disclosure

Daily Gaming is required by U.S. law to report certain winnings to the Internal Revenue Service. Users who receive cumulative net winnings of $600 or more in a calendar year may receive IRS Form 1099-MISC or 1099-NEC and will be required to complete a W-9 form through our tax reporting partner, Tax1099. Tax identification information (SSN or TIN) is submitted directly to Tax1099 and is not stored on Daily Gaming servers. This information is transmitted to the IRS as required by law and retained in accordance with federal record-keeping requirements.

Daily Gaming implements reasonable administrative, technical, and organizational safeguards to protect user information from unauthorized access, disclosure, or misuse. These measures include encrypted data transmission (TLS), access controls, and secure cloud infrastructure.

However, no internet transmission or storage system can be guaranteed to be completely secure. Users are responsible for maintaining the security of their own account credentials.

Account and Data Deletion

You may request deletion of your account and associated personal data at any time by contacting support@daily-gaming.com with the subject line "Account Deletion Request". Before deletion is processed, any pending contests must be concluded and any available wallet balance must be withdrawn. Following deletion, Daily Gaming will remove or anonymize your personal data except where retention is required by law, for tax reporting, or for fraud prevention purposes as described above.

In-App Deletion: Account deletion can also be initiated from within the app under Account Settings. In-app deletion requests are processed on the same basis as email requests.

8. California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

9. Cookies and Analytics

Daily Gaming may use cookies or similar technologies on its website to analyze usage and improve user experience. The mobile app may use device-based analytics SDKs for crash reporting and usage analytics.

Website users may disable cookies through their browser settings, though certain features may not function properly. Mobile users may limit certain analytics data collection through their device's privacy settings (e.g., Limit Ad Tracking on iOS, Opt out of Ads Personalization on Android).

10. Children's Privacy

Daily Gaming is intended only for users who are at least 18 years old or the legal age of majority in their jurisdiction, whichever is higher. The Platform does not knowingly collect personal information from individuals under this age. If we become aware that personal information has been collected from a minor without parental consent, we will promptly delete that information and close the associated account.

11. International Users

Daily Gaming operates from the United States and is intended for users in permitted U.S. jurisdictions. By using the Platform, users outside the United States acknowledge that their information may be transferred to, processed, and stored in the United States, where privacy laws may differ from those in their country of residence.

The Platform may contain links to third-party websites or services. Daily Gaming is not responsible for the privacy practices of those third parties. We encourage users to review the privacy policies of any third-party services they access through or in connection with the Platform.

13. Changes to this Policy

Daily Gaming may update this Privacy Policy periodically. We will notify users of material changes through the app or by email prior to the changes taking effect. Continued use of the Platform following updates constitutes acceptance of the revised policy. The "Last Updated" date at the top of this page reflects the most recent revision.
