DMCA Policy

Daily Gaming LLC ("Daily Gaming") respects the intellectual property rights of others and expects users of the Platform to do the same. This policy describes how Daily Gaming responds to claims of copyright infringement under the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

Daily Gaming qualifies for the DMCA safe harbor protections available to online service providers under 17 U.S.C. § 512(c). To maintain those protections, Daily Gaming has designated a Copyright Agent to receive notifications of claimed copyright infringement.

Daily Gaming's Copyright Agent is also registered with the U.S. Copyright Office as required by 17 U.S.C. § 512(c)(2).

2. Reporting Copyright Infringement — Takedown Notice

If you believe that content available on or through the Daily Gaming Platform infringes your copyright, you may submit a written notification to our Copyright Agent. To be valid under the DMCA, your notification must include all of the following elements (17 U.S.C. § 512(c)(3)):

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit Daily Gaming to locate the material on the Platform (such as a URL or specific description of where the content appears).
Your contact information, including your full legal name, mailing address, telephone number, and email address.
A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Do not submit a takedown notice if you are not certain the content infringes your copyright.

3. Daily Gaming's Response to Takedown Notices

Upon receipt of a complete and valid DMCA takedown notice, Daily Gaming will:

Promptly remove or disable access to the allegedly infringing material
Notify the user who submitted the content that it has been removed
Provide the user with a copy of the takedown notice (with your personal contact information redacted where permitted)

Please note that Daily Gaming may forward a copy of the complete takedown notice to the user who posted the content, including any contact information you provide.

4. Counter-Notification

If you believe that material you submitted to the Platform was removed or disabled as a result of a DMCA takedown notice that was submitted in error or based on a misidentification of the material, you may submit a counter-notification to our Copyright Agent.

A valid counter-notification must include all of the following (17 U.S.C. § 512(g)(3)):

Your physical or electronic signature.
Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your full name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Daily Gaming may be found), and that you will accept service of process from the person who provided the original DMCA notification or their agent.

Upon receipt of a valid counter-notification, Daily Gaming will:

Forward the counter-notification to the original complainant
Inform the complainant that Daily Gaming will restore the removed material within 10 to 14 business days unless the complainant files a court action seeking an order to restrain the user from the infringing activity
Restore the removed material within 10 to 14 business days following receipt of the counter-notification, absent a court order

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability for damages, including costs and attorneys' fees.

5. Repeat Infringers

Daily Gaming maintains a policy of terminating accounts of users who are determined to be repeat infringers of copyrights or other intellectual property rights. Daily Gaming will terminate accounts of users who receive multiple valid DMCA takedown notices at Daily Gaming's sole discretion.

6. What Daily Gaming Does Not Host

Daily Gaming is a competitive gaming platform. Users are permitted to submit photographs of game score screens as proof of contest results. These photos are submitted by users and are not content created or published by Daily Gaming. Daily Gaming does not knowingly host copyrighted game footage, video recordings, game assets, music, or other copyrighted material beyond incidental display in result verification photos.

If you believe Daily Gaming is hosting material that infringes your copyright beyond result verification photos, please provide a detailed description in your takedown notice.
